Ready to Help You Establish or Contest Paternity in Montgomery County
A father’s role in family life is extremely important, and paternity laws have grown over time to establish the legal relationship between a father and his biological or adopted children. This complex area of law is relevant to establishing legitimacy, inheritance and other issues. It is also critical when handling child custody matters in the case of divorce or obligations for child support.
When faced with paternity contests, The Woodlands paternity lawyers at Morgan Bourque Attorney at Law have the experience and reputation to maintain a presence in your child’s life. As the paternity lawyer of record in several Texas court hearings, Morgan Bourque uses his knowledge and experience as a former prosecutor to create effective and personalized legal solutions that work best for you.
Establishing the child’s paternity – determining the child’s legal father - is one of the first steps in a child custody or child support case. A legal father has certain rights and responsibilities as a child’s parent.
When a couple is married when their child is born, the husband is automatically considered the child’s biological father. However, when a couple isn’t married, there are two additional steps to establish paternity: by voluntarily signing an “Acknowledgement of Paternity” form or involuntarily through family court. If the latter occurs, a judge can order a DNA test to determine the identity of the child’s biological father.
The court will make a final decision according to the results. If the results identify the alleged father as the biological father, he will be issued an order of adjudication parentage and his name will be added to the child’s birth certificate. As soon as paternity is determined, other family matters such as child custody and child support may move forward.
