Establishing Paternity in Texas
Establishing the child’s paternity – determining the child’s legal father - is one of the first steps in a child custody or child support case. A legal father has certain rights and responsibilities as a child’s parent.
When a couple is married when their child is born, the husband is automatically considered the child’s biological father. However, when a couple isn’t married, there are two additional steps to establish paternity: by voluntarily signing an “Acknowledgement of Paternity” form or involuntarily through family court. If the latter occurs, a judge can order a DNA test to determine the identity of the child’s biological father.
The court will make a final decision according to the results. If the results identify the alleged father as the biological father, he will be issued an order of adjudication parentage and his name will be added to the child’s birth certificate.
